1. Marketplace Only
FilmAset (“FilmAset,” “we,” “us,” or “our”) operates solely as an online marketplace that connects independent Property Hosts (“Hosts”), Film Productions (“Guests” or “Productions”), and Catering Vendors (“Vendors”). FilmAset is not the owner, operator, property manager, employer, insurer, food provider, or agent for any listing, production, or vendor on the platform. Bookings and orders are agreements between independent parties.
2. Marketplace Disclaimer
FilmAset is strictly a digital marketplace. FilmAset does not:
- Employ Hosts, Film Crews, or Catering Vendors.
- Own or operate any listed property.
- Own or operate any food business.
- Guarantee the accuracy of any listing, menu, or vendor claim.
3. Host Responsibilities
Hosts are solely responsible for:
- Property access, keys, and site coordination.
- Obtaining and maintaining all required permits.
- Maintaining valid property, liability, and commercial-use insurance.
- Compliance with local, state/provincial, and federal laws.
- On-site safety and conduct during production activities.
Before publishing a listing, every Host must certify: “I certify that I maintain valid and active homeowner’s, renter’s, or commercial property liability insurance for this location. I acknowledge that FilmAset does not provide property insurance and that I am solely responsible for ensuring my policy permits temporary commercial filming usage.”
4. Filmmaker & Production Responsibilities
Guests are solely responsible for production activities, crew conduct, obtaining permits, carrying production insurance, and leaving locations in their original condition.
5. Catering Guidelines & Vendor Responsibilities
FilmAset only connects productions with independent food vendors. Vendors are solely responsible for:
- Health permits, food handler certifications, and business licensing.
- Food safety, preparation, storage, and transport.
- Accurate allergen labeling and dietary disclosures.
- Delivery, pickup, and food-truck parking arrangements.
- Compliance with all local, state/provincial, and federal food regulations.
FilmAset never prepares, transports, stores, or inspects food.
6. Payments
Payments are securely processed through Stripe. FilmAset is not responsible for banking delays, payment processor outages, chargebacks, or financial institution errors. Platform commission is 25% on location bookings and 10% on catering orders unless otherwise stated.
7. Insurance
FilmAset does not provide insurance unless explicitly stated in writing. Hosts, Productions, and Vendors are responsible for maintaining their own insurance coverage appropriate to their activities on the platform.
8. Limitation of Liability
To the fullest extent permitted by law, FilmAset disclaims liability for:
- Property damage of any kind.
- Personal injury or death.
- Theft, vandalism, or loss of equipment.
- Food-borne illness or allergic reactions.
- Production delays or cancellations.
- Insurance disputes between parties.
- Financial loss, lost revenue, or lost profits.
- Booking or order disputes between independent parties.
9. Reporting & Safety
Users may report listings, users, or vendors via in-product controls. FilmAset reviews reports in good faith but makes no guarantee regarding outcomes.
10. Governing Law
These Terms are governed by the laws of the jurisdiction in which FilmAset is incorporated, without regard to conflicts of laws principles.
11. Changes
We may update these Terms from time to time. Continued use of the platform after updates constitutes acceptance.
